WHY IS SOUKSOMBOUN SEPARATED FROM THE OTHER 6 DEFENDANTS?
Souksomboun hired his own separate lawyer (Urban) thus is not being represented as a group with the other defendants.
WHAT IS A PLEADING?
Pleadings are all the formal documents filed with the court by both the plaintiff and the defendant stating the parties' position, facts, issues i the case, etc.
WHAT IS A CHARITABLE NON-PROFIT?
Ha no shareholders, but can and should be profitable and earn profit to further its charitable purpose
IS THE TEMPLE FOR SALE?
Temple is not for sale - the Temple will never be for sale. Federal Law and our own legally compliant Articles of Incorporation state that the assets of the organization can never be used to benefit an individual or corporation that is not also a 501c3. That means that even if the Temple ever had to close its operation - the state and federal government would oversee the transfer or the assets to another similar 501c3 organization. WHAT IS A 501c3 CHARITABLE ORGANIZATION?
Any non-stock (no shareholders or owners) corporation from any state may apply to the IRS to be recognized as a 501c3 Charity under the federal tax code. The process takes approximately 6-24 months and requires submitting evidence of the federal and state compliance procedures for the organization.
When an organization is approved - the IRS issues a LETTER OF DETERMINATION. If an organization states that they are a 501c3 BEFORE they have been approved by the IRS, then they are violating federal law and their application for consideration (if any is ever filed will likely be denied). 501c3 non-profit charitable orgs have the right to borrow money. In accordance with Federal Banking Regulations, the organization must prove to the lending Bank that the purpose of the loan is to benefit the organization. The bank who makes the loan is required by Federal Banking Regulations to verify the authority, intended use, and actual use of any loan that it makes to any 501c3 Organization. The lending bank always requires records of legal verification and annual financial reports.
WHAT ARE 501c3 OFFICERS AND DIRECTORS?
The Board Members (DIRECTORS) of a 501c3 do not own anything. They are legally responsible and publicly accountable for creating and overseeing the long term vision for the organization.
The Officers (PRES, VP, SEC TREAS) of a 501c3 also do not own anything. They are legally responsible and publicly accountable for managing the day to day operations of the organization in accordance with the long term vision of the Board Members.
It is typical for some small organizations to name the same people as Directors and Officers and although it is not required, it is not prohibited.
At Wat Lao Buddhavong, and many other Temples and churches in the US, the Venerable Monks who live at the Temple serve as both the Spiritual and Temporal (legal) leaders. The Venerables usually ask a few members of the congregation to assist them with their temporal responsibilities - which include managing the day to day operations of the organization and facilitating best practices for implementing the long term vision for the organization.
